Volunteer Liability Waiver
PLEASE READ CAREFULLY BEFORE PARTICIPATING
By participating in Earth Arts Unlimited harvest activities, I acknowledge and agree to the following:
- I understand that harvesting fruit and produce involves physical activity and potential risks including but not limited to: ladder use, tool operation, exposure to weather conditions, insects, allergens, and uneven terrain.
- I acknowledge that I am participating voluntarily and assume all risks associated with harvest activities.
- I agree to follow all safety guidelines provided by Earth Arts Unlimited coordinators and homeowners. I have read and agree to abide by the Volunteer Best Practices and all other guidelines listed in the Education Hub.
- I acknowledge that if I have a life threatening allergy to bees that I will be responsible for my own health by either choosing not to participate or ensuring that I carry an up-to-date EPI pen on my person at all times and agree to inform harvest coordinator of my life threatening bee allergy status before beginning the harvest. I further agree that I am responsible for anything that may arise from my presence at the harvest should I encounter a bee sting.
- I agree to wear appropriate protective attire and to pay attention to my surroundings on location at harvests, including but not limited to the following: above ground irrigation parts, proper harvest techniques and personal body mechanics while harvesting, proper ladder use, fellow volunteers working near me, thorns on branches while reaching through the tree, where I place my head and face in the branches, and avoiding breaking branches.
- I will inspect all equipment before use and refrain from using any equipment I deem unsafe.
- I release and hold harmless Earth Arts Unlimited, its coordinators, homeowners, and other volunteers from any and all claims, demands, or causes of action arising from my participation.
- I consent to emergency medical treatment if necessary and assume financial responsibility for any medical costs incurred.
- I grant permission for Earth Arts Unlimited to use photographs or videos of harvest activities for promotional purposes.
This waiver is binding on my heirs, executors, and assigns. If any portion is held invalid, the remainder shall continue in full force.

Homeowner Access & Liability Waiver
PROPERTY ACCESS AGREEMENT
By requesting a harvest through Earth Arts Unlimited, I acknowledge and agree to the following:
- I grant permission for Earth Arts Unlimited volunteers to access my property on the scheduled harvest date(s) for the purpose of harvesting fruit and produce, including, if necessary, access to the restroom for volunteers. Volunteers will remove shoes before entering home for restroom use.
- I certify that my property is reasonably safe for harvest activities and I have disclosed all known hazards including but not limited to: aggressive animals, unstable structures, electrical hazards, bee/wasp nests, poisonous plants, and access limitations.
- I understand that volunteers are not professional arborists or gardeners and that pruning or tree damage may occur during harvest activities.
- I release and hold harmless Earth Arts Unlimited, its coordinators, and volunteers from any claims related to property damage, personal injury, or harvest outcomes.
- I agree that harvested produce will be distributed according to Earth Arts Unlimited policies, which typically allocate: 1/2 shared with community; 1/4 left with homeowner; 1/4 shared with volunteers.
- I understand that harvest dates are weather-dependent and may be rescheduled if conditions are unsafe.
- I agree to be present or designate a responsible adult representative during the harvest activity.
- I certify that I have legal authority to grant access to this property.
This agreement is binding and shall remain in effect for all harvest activities scheduled through Earth Arts Unlimited during the current calendar year.

Volunteer Best Practices
Safety First
- Always inspect ladders and equipment before use. If it looks unsafe, don't use it.
- Always ensure all 4 feet of your ladder are squarely on the ground before climbing.
- Always use a spotter to steady the ladder when climbing above 8 feet on any ladder or if you desire for any reason.
- Wear closed-toe shoes, long pants, and sun protection. Gloves are recommended. We recommend to bring gloves, long sleeves and a bandana, a sun hat, and a water bottle.
- Stay hydrated and take breaks, especially in hot weather.
- Never climb higher than the second-to-last step on a ladder.
- Use a spotter when working on ladders or reaching high branches.
- Be aware of bees, wasps, and other insects. If allergic, carry appropriate medication.
- Communicate with your team about movements and potential hazards.
Responsible Harvesting
- Pick only ripe fruit. When in doubt, ask the homeowner or coordinator.
- Use proper picking technique: twist and lift gently to avoid damaging branches.
- Handle and clean produce carefully to avoid bruising and damaging harvested fruit and prevent wasted harvest.
- Sort as you pick: separate damaged fruit from good quality produce.
- Don't prune branches carelessly or needlessly. We are harvesting, not tree trimming. Please take care not to break branches and only prune as needed to ensure access to the harvest. Coordinators can teach proper branch pruning techniques as needed. Always ask first before pruning.
- Respect the property - stay in designated harvest areas unless otherwise directed.
Being a Great Guest
- Arrive on time or communicate if you're running late.
- Introduce yourself to the homeowner and thank them for sharing their harvest.
- Clean up thoroughly - leave the site tidier than you found it.
- Dispose of damaged fruit in compost bins if available, or as directed.
- Close gates, return equipment to its proper place, and secure access areas.
- Be respectful of the homeowner's time and property boundaries.
- Be mindful of your choices to engage in the following topics of your conversation as we build community: Avoid religious proselytizing, political argument, using any rude or offensive language including cursing or any form of hate speech. We seek to connect and share the best of ourselves and lift each other up to brighter times and better friendships. Let's stay focused on what brings us forward together as we get to know each other and enjoy each other's company throughout the harvest process.

Homeowner Tree Care Tips
Basic Pruning Guidelines
- Best Time: Prune most fruit trees during dormancy (late winter/early spring before bud break).
- The 3 D's: Always remove Dead, Diseased, or Damaged branches first.
- Air & Light: Thin the canopy to allow sunlight and air circulation - this prevents disease and improves fruit quality.
- Angle Matters: Make cuts at a 45-degree angle just above an outward-facing bud.
- Shape: Maintain an open center or modified leader shape depending on tree type.
- Young Trees: Focus on establishing strong structure rather than fruit production in the first 2-3 years.
- Mature Trees: Limit removal to no more than 25% of the canopy in a single year.
Common Local Pests & Solutions
- Aphids: Small green/black insects on new growth. Spray with water or use insecticidal soap. Encourage ladybugs.
- Codling Moths: Cause wormy apples/pears. Use pheromone traps and remove fallen fruit promptly.
- Scale Insects: Brown bumps on branches. Apply horticultural oil in dormant season.
- Fruit Flies: Affect stone fruits and citrus. Use yellow sticky traps and harvest promptly.
- Powdery Mildew: White powder on leaves. Ensure good air circulation and consider sulfur spray.
- Fire Blight: Blackened shoots (looks burnt). Prune 12" below infection and sterilize tools between cuts.
- Prevention: Healthy trees resist pests better. Water deeply but infrequently, mulch, and fertilize appropriately.
Optimal Harvest Timing
- Apples: Ripe when seeds are brown and fruit separates easily with a gentle twist. Skin color deepens.
- Pears: Pick while still firm; they ripen off the tree. Test firmness near the stem.
- Stone Fruits: Slight softening, color change, and sweet aroma indicate ripeness.
- Citrus: Color alone doesn't indicate ripeness - taste test! Citrus can stay on the tree for months.
- Figs: Soft to touch, drooping on stem, and possibly splitting at bottom.
- Persimmons: Fully colored and soft for Hachiya type; firm and orange for Fuyu type.
- General Rule: Early morning harvesting after dew dries provides best quality and storage life.

1. Welcome & Acceptance of These Terms
Thank you for being part of the Earth Arts Unlimited community. These Terms of Service ("Terms") govern your use of this website and the community harvest coordination services it provides. By using this site, including requesting a harvest, signing up to volunteer, making a donation, or simply browsing, you agree to these Terms. If you do not agree, please do not use the site.
These Terms are written in plain language so everyone can understand them. They are not legal advice. If you have questions, contact us at earthartsunltd@gmail.com.
2. What We Do
Earth Arts Unlimited connects homeowners who have excess fruit with volunteers who help harvest (glean) it, in order to reduce food waste and feed our community. Through this site you can:
- Request a harvest at your property
- Sign up to volunteer at scheduled harvests
- Learn about composting, tree care, and sustainability
- Support our work through donations and optional volunteer tips
We are a community program, not a commercial harvesting service. Harvest scheduling depends on volunteer availability, weather, and crop conditions, and we cannot guarantee that every request will be fulfilled.
3. Your Responsibilities
- Provide accurate, current information when submitting forms (name, contact details, property information).
- Only submit information about yourself, or about others with their permission.
- Use the site respectfully: do not submit false requests, spam, offensive content, or attempt to interfere with the site's operation.
- Follow coordinator instructions and safety guidance at harvest events.
We may decline, edit, or remove any request or signup that appears inaccurate, unsafe, or abusive.
4. Volunteers: Safety & Assumption of Risk
Harvesting involves physical activity, including ladders, tools, uneven ground, sun exposure, and lifting. By volunteering, you acknowledge these risks and agree to participate carefully and within your own physical limits. Volunteers are expected to review and agree to our volunteer waiver, available on the Waiver & Safety page, which contains the full assumption-of-risk and release terms. Minors may volunteer only with a parent or guardian's consent and supervision.
5. Homeowners: Property & Access
By requesting a harvest, you confirm that you own the property or have the owner's permission, and you grant our volunteers and coordinator permission to enter the property at the scheduled time to harvest. Please disclose any known hazards (dogs, unstable ground, chemical treatments on trees, etc.) in your request notes. Harvested produce is gleaned for community distribution; arrangements about keeping a portion can be discussed with the coordinator. Homeowners should review the homeowner documentation on the Waiver & Safety page.
6. Payments, Donations & Tips
- Card payments (donations and optional volunteer tips) are processed by Stripe, a third-party payment processor. Your card details are entered on Stripe's secure checkout pages and are never stored on our servers. Stripe's own terms and privacy policy apply to those transactions.
- Zelle payments are sent directly to earthartsunltd@gmail.com through your own bank and are governed by your bank's and Zelle's terms, not this site.
- Cash and Zelle tip pledges you record on a harvest request are tracked so our coordinator can confirm them, but the payment itself happens outside this site.
- Donations and tips are voluntary. Recurring monthly donations can be managed or cancelled through the Stripe billing portal link provided after checkout. If you believe a payment was made in error, contact us at earthartsunltd@gmail.com and we will work with you in good faith.
7. Privacy & How We Use Your Data
We aim to collect only what we need to coordinate harvests, and to be honest about how it is stored and used.
What we collect
- Harvest requests: your name, email, phone number, property address, requested date/time, plant and yield details, notes, optional tip pledge, and whether you consent to marketing contact.
- Volunteer signups: your name, email, phone number, chosen harvest date, anonymity preference, and marketing consent.
- Volunteer profiles: a record keyed to your email that tracks attendance history and your display/anonymity preference (used for coordination and the coordinator-only leaderboard).
- Payment records: when a Stripe payment completes, we store a record of the payment type, amount, and related metadata, but never your card number.
- Harvest photos: our coordinator may photograph completed harvests. Photos of your property are shared publicly (for example in our "Recent Harvests" gallery) in line with the marketing consent you give on your request.
Where it lives
- Form data is stored in Google Firebase (Firestore); harvest photos are stored in Firebase Storage.
- Please note: to make features like the volunteer calendar and capacity tracking work, harvest request, volunteer signup, and volunteer profile records (which can include your email, phone, and anonymity preference) are technically readable by the public through our database. Do not include anything in a form that you would not be comfortable being visible, and know that names, contact details, and addresses you submit are handled this way. We display volunteer names only to our signed-in coordinator, and we honor anonymity preferences in anything we publish.
- Some data may also be cached in your own browser (localStorage) so the site works during connection issues; that copy stays on your device.
How we use it
- Coordinating harvests: scheduling, contacting you, tracking volunteer capacity and attendance, and recording pounds harvested.
- Program statistics: aggregate totals (pounds harvested, volunteer counts) shown on the home page.
- Marketing contact: only if you check the marketing consent box. You can withdraw consent anytime by emailing us.
- We do not sell your personal information.
Your choices
- You may request a copy, correction, or deletion of your personal data by emailing earthartsunltd@gmail.com. We will respond as promptly as we reasonably can.
- Volunteers may choose to appear as "Anonymous Volunteer" in any published materials.
- You may ask us to remove photos of your property from the public gallery at any time.
8. Third-Party Services
This site relies on services we do not control, each with their own terms and privacy practices:
- Google Firebase (data storage, photo storage, coordinator login)
- Stripe (card payment processing and subscription management)
- Zelle (bank-to-bank payments made outside this site)
We are not responsible for the availability or conduct of these third-party services.
9. Educational Content Disclaimer
Content on our Education Hub, Compost, and Sustainability Consultation pages is provided for general information. Gardening, composting, and tree-care outcomes vary; use your own judgment and consult professionals where appropriate.
10. Disclaimers & Limitation of Liability
The site and our services are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Earth Arts Unlimited, its coordinator, and its volunteers are not liable for indirect, incidental, or consequential damages arising from your use of the site or participation in harvests. Nothing in these Terms limits liability that cannot lawfully be limited. The separate waivers on the Waiver & Safety page govern in-person harvest activities.
11. Changes to These Terms
We may update these Terms from time to time as the program evolves. The "Last updated" date at the top reflects the latest revision. Continued use of the site after changes means you accept the updated Terms. For significant changes, we will do our best to make the update noticeable.
12. Governing Law
These Terms are governed by the laws of the State of Nevada, USA, where our program operates, without regard to conflict-of-law principles.
